Privacy policy

1. Scope and contracting party

These General Terms and Conditions apply to orders placed through the online store at www.the247standard.com.

The contracting party is E.Syla, trading as 247 STANDARD, Gutenbergstraße 7, 4052 Ansfelden, Austria, telephone +43 677 5076241, email info@the247standard.com (hereinafter "247 STANDARD").

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business customer is a person who enters into the contract in the course of their trade, business or profession.

The version of these General Terms and Conditions available in the store at the time of the order applies.

2. Offer and conclusion of the contract

The presentation of products in the online store does not constitute a legally binding offer. It is an invitation to the customer to submit an order.

The customer places products in the cart, enters the delivery and payment information and may correct input errors before submitting the order by using the available editing functions. By clicking the "Order with obligation to pay" button, the customer submits a binding offer to conclude a purchase contract.

247 STANDARD will acknowledge receipt of the order immediately by email. This acknowledgement does not constitute acceptance unless it is expressly designated as an order acceptance.

The contract is concluded when 247 STANDARD accepts the order by sending a separate order confirmation or dispatches the goods, whichever occurs first. If the offer is not accepted within five working days, the customer is no longer bound by it; any payments already made will be reimbursed without undue delay.

The contract language is German. If the store is offered in an additional language, the contract may also be concluded in that language. The contract text and order details are stored in accordance with statutory retention obligations and are provided to the customer on a durable medium together with the order or contract confirmation.

3. Products and availability

The essential characteristics, materials, sizes, colours and care instructions are set out in the relevant product description. Minor colour variations between the on-screen display and the product may occur for technical reasons, provided they are reasonable and do not alter the agreed characteristics of the product.

If an ordered product is exceptionally unavailable, the customer will be informed without undue delay. Any amount already paid will be reimbursed without undue delay using the original means of payment.

For pre-orders or products with a later release or delivery date, the delivery period expressly stated on the product page applies.

4. Prices and shipping costs

All prices shown in the store are total prices in euros. They include statutory VAT where applicable, but do not include additional shipping costs.

Shipping costs, delivery restrictions and available means of payment are clearly displayed no later than at the beginning of the ordering process and again before the customer submits the order with an obligation to pay.

For price reductions, the legally relevant lowest price applied during the previous 30 days is used as the reference price where required by law.

5. Payment

The means of payment displayed in the checkout are available. The purchase price is due when the contract is concluded, unless otherwise specified for the selected means of payment.

In the event of a chargeback or failed payment, the customer bears only those costs for which the customer is responsible and which were actually and reasonably incurred.

6. Delivery

Delivery is available only to countries that can be selected in the Shopify checkout. The delivery address must be located within an available delivery area.

The delivery period stated on the product page or in the checkout applies. If no other delivery period has been agreed, delivery will take place without undue delay and no later than 30 days after the contract is concluded.

Partial deliveries are permitted only where reasonable for the customer. 247 STANDARD bears any additional shipping costs arising from a partial delivery initiated by 247 STANDARD.

For consumers, the risk of accidental loss or accidental deterioration passes only when the goods are handed over to the customer or to a third party designated by the customer. If the customer independently commissions a carrier not offered by 247 STANDARD, the applicable statutory special rules apply.

7. Retention of title

The goods remain the property of 247 STANDARD until the purchase price has been paid in full.

8. Right of withdrawal

Consumers have the statutory right of withdrawal. Details are set out in the separate Instructions on the Right of Withdrawal, including the Model Withdrawal Form, which are permanently available in the store and are provided with the contract confirmation.

A voucher or store credit will be issued instead of a monetary reimbursement only if, after exercising the right of withdrawal, the customer expressly and voluntarily agrees to it. Without such an agreement, reimbursement will be made using the same means of payment used for the original transaction.

The statutory right of withdrawal also applies to sale items. It is not excluded because original packaging is missing or tags have been removed; however, handling beyond what is necessary to inspect the goods may result in liability for diminished value as provided by law.

9. Statutory warranty

The statutory warranty provisions apply. 247 STANDARD is liable for defects that existed when the goods were handed over and become apparent within the statutory period. For new movable goods, the statutory warranty period is generally two years from handover; statutory limitation periods and burden-of-proof rules remain unaffected.

In a warranty case, the consumer may first request that the goods be brought into conformity by repair or replacement, provided the statutory requirements are met. A price reduction or termination of the contract is governed by the statutory provisions.

A voluntary commercial guarantee applies only if it is expressly offered for the relevant product. A commercial guarantee does not restrict statutory warranty rights.

10. Complaints and customer service

Complaints may be submitted to info@the247standard.com or by telephone on +43 677 5076241. 247 STANDARD will seek a prompt and amicable solution.

247 STANDARD has not voluntarily submitted to an alternative dispute resolution body. If no agreement is reached in a specific dispute, consumers will be informed, in accordance with the Austrian Alternative Dispute Resolution Act, of the competent body and whether 247 STANDARD will participate in the procedure.

The former EU Online Dispute Resolution platform was discontinued on 20 July 2025 and is therefore not linked.

11. Liability

247 STANDARD is liable in accordance with the statutory provisions. Mandatory statutory claims, in particular those relating to personal injury, product liability, statutory warranty, intent or gross negligence, are not excluded or restricted.

12. Data protection

Information about the processing of personal data is provided in the separate Privacy Policy.

13. Applicable law and jurisdiction

Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the country in which the consumer habitually resides.

The statutory places of jurisdiction apply to consumers. No exclusive place of jurisdiction is agreed with consumers.

14. Final provisions

If any provision of these General Terms and Conditions is wholly or partially invalid, the remaining provisions remain unaffected. The invalid provision will be replaced by the applicable statutory rules.
